The Law Commission is seeking views on the legislation pertaining to criminal appeals, particularly the tests applied by the Criminal Cases Review Commission and the Court of Appeal, as well as the legislation controlling the disclosure of evidence and its retention after trial.
In July 2022, the Government asked the Law Commission to review the laws governing criminal appeals, with the aim of enabling effective, appropriate and efficient resolutions of appeals. The Law Commission is in the process of identifying any areas of the law where reform is needed in order to correct any miscarriages of justice and ensure the efficient, appropriate and fair dealing of appeal cases.
The Law Commission intends to publish its consultation paper in 2024, outlining the areas requiring reform, along with tentative suggestions for improvement.
