Compensation claims against the Ministry of Justice for victims of miscarriages of justice

Southwell and Partners advises individuals on applications for compensation as the victim of a miscarriage of justice. Such applications are made to the Ministry of Justice and follow a two stage process of liability followed by quantum, should the application be accepted for compensation.

Many victims of miscarriages are also victims of human trafficking and in many cases they come within the very limited criteria for compensation under section 133 of the Criminal Justice Act 1988. Advising on such matters is complex and requires experience to ensure that claims include all elements requiring of compensation and that the payments made are adequate in the circumstances. We were involved in the first miscarriage of justice compensation claim for a victim of human trafficking under this scheme.
